This case arises from the fraudulent procurement of a life insurance policy with a death benefit of $2 million. On or about July 18, 1996, plaintiff issued the policy on the life of Jack Lebowitz, who was purported to have signed the application and medical form in four places, and to have appeared for a medical examination in Brooklyn, on April 30, 1996.

On that date, he was actually a cancer patient in Community Hospital...
