{¶ 1} Pursuant to a plea agreement, defendant-appellant pleaded guilty in common pleas court case No. 2003-CR-242 to two counts of rape of a child under 13. R.C. 2907.02(A)(1)(b). In exchange, the state dismissed charges of gross sexual imposition and sexual battery.
