In this case, we must consider the effect of the Texas Supreme Court's opinion in Butnaru v. Ford Motor Co., 84 S.W.3d 198 (Tex.2002) ("Butnaru"), on related proceedings in the Motor Vehicle Board of the Texas Department of Transportation that predate the opinion. The Board dismissed with prejudice the Butnarus' complaints against Ford concerning possible violations...
