ELSA ALCALA, Justice.

Appellant, Penny Baker, pleaded not guilty to the misdemeanor offense of driving while intoxicated (DWI). The jury found him guilty. In accordance with an agreed recommendation between the State and appellant, the trial court assessed a suspended punishment of 180 days in jail, and a fine of $1,000, and placed appellant on community supervision.
