The IAS court erred both in granting the petition "under the presumption of validity" and in ignoring the issue of the statute's validity raised by respondents. Local Law 27 of 2004 (enacting Equal Benefits Law [Administrative Code of City of NY] § 6-126) is a restriction against the City doing business with certain vendors (with $100,000 or more in city contracts over the preceding 12 months) that discriminate between employees with spouses and those with domestic partners...
