VEAL v. STATE

No. 3D03-3232.

895 So.2d 1280 (2005)

Ernest Lee VEAL, Appellant, v. The STATE of Florida, Appellee.

District Court of Appeal of Florida, Third District.

March 16, 2005.

Attorney(s) appearing for the Case

Bennett H. Brummer, Public Defender and Billie Jan Goldstein, Assistant Public Defender, for appellant.

Charles J. Crist, Jr., Attorney General and Paulette R. Taylor, Assistant Attorney General, for appellee.

Before GREEN, CORTINAS, and ROTHENBERG, JJ.

CONFESSION OF ERROR

PER CURIAM.

Pursuant to the state's proper confession of error, we reverse the order denying defendant's motion for post-conviction relief to vacate his sentence. As the state correctly asserts, the trial court erred in denying defendant's request for the assistance of counsel at resentencing, see, e.g., Sanchez v. State, 866 So.2d 218
