GOODMAN v. CROWN LEASING CORP.

No. 4D04-2429.

913 So.2d 1241 (2005)

Scott M. GOODMAN d/b/a Sportsworld, Appellant, v. CROWN LEASING CORPORATION, a Texas corporation, and Billy Sims, individually, Appellees.

District Court of Appeal of Florida, Fourth District.

November 9, 2005.

Attorney(s) appearing for the Case

Allen H. Libow and Chad R. Laing of Libow & Shaheen, LLP, Boca Raton, for appellant.

David Kovari of the Law Offices of David Kovari, P.A., Boca Raton, for appellee Crown Leasing Corporation, a Texas corporation.

PER CURIAM.

This case involves the ownership of a Heisman Trophy awarded to Billy Sims in 1978. The issue on appeal is whether the trial court erred in dismissing a counterclaim based on the defendant/counter-plaintiff's failure to join an indispensable party where the counterclaim does not demonstrate that such party is indispensable. We conclude that the trial court erred in dismissing the counterclaim and reverse.
