Defendant appeals from a judgment of conviction on eight counts of identity theft and one count of unlawful use of a computer. At trial, the court disallowed his demurrer to the indictment under the identity theft statute, ORS 165.800, concluding that it did not violate the free speech guarantees in the Oregon and United States constitutions.
