In this workers' compensation case, Theresa Hamilton, a public school teacher, was injured while she accompanied a class on a school-sponsored field trip. The injury occurred on La. Hwy. 6 which is maintained by the State of Louisiana, through the Department of Transportation and Development (DOTD). Ms. Hamilton filed a tort suit against the DOTD. The DOTD filed a motion for summary judgment arguing that workers' compensation is the sole remedy...
