BISHOP, J.

The defendant city of New Haven1 appeals from the judgment of the trial court rendered after the jury's verdict in favor of the plaintiff, Michael DeMatteo. The plaintiff brought an action pursuant to General Statutes § 13a-149, the municipal defective highway statute. On appeal, the defendant claims that the court improperly failed to set aside the verdict. We affirm the judgment of the trial court.
