OPINION

MAY, Judge.

Annette Donica Giles ("Giles") appeals a summary judgment for Brown County in a civil suit arising from the death of her husband, Joey Giles ("Joey"). Giles raises one issue, which we restate as whether the trial court erred in granting summary judgment to Brown County.1

We reverse and remand.
