Defendant, Jerry Magee, was convicted of armed robbery in violation of LSA-R.S. 14:64, and was sentenced to ninety-nine years imprisonment at hard labor without benefit of probation, parole or suspension of sentence.

Pursuant to a multiple offender bill of information, defendant was found to be a fourth felony offender. After vacating defendant's originally imposed sentence, the trial court re-sentenced defendant to imprisonment...
