OPINION

ROBB, Judge.

Porter County Sheriff Department ("PCSD") appeals the trial court's denial of its motion for summary judgment. We reverse and remand.

Issue

PCSD raises one issue for our review, which we restate as whether the trial court properly denied PCSD's motion for summary judgment.
