FACTS AND PROCEDURAL HISTORY

¶ 1. Stanley Starks was terminated from his employment as a canine officer with the Fayette Police Department on July 17, 2001, for "conduct unbecoming an officer." While on the police force, Starks's immediate supervisor was Lee Nichols, the Fayette Police Department's chief of police.
