[¶ 1] On December 4, 2002, appellant, Michael S. Wilkins (Wilkins), entered a conditional plea of nolo contendere1 to the crime of third degree sexual assault.2 In addition to the complaint from the victim of the crime, a very important piece of evidence against Wilkins was a confession he made after taking a polygraph test that indicated he was being untruthful in his answers.
