The State charged Ward Atkins with Unlawful Possession of Firearm by Serious Violent Felon, as a Class B felony. Atkins moved to suppress the evidence in support of the charge, alleging that it was obtained as the result of an unconstitutional investigatory stop. The trial court granted Atkins' motion.
