In 1997, V.S. was tried and convicted of sodomy in the first degree and was sentenced to 20 years' imprisonment. On August 28, 1998, the Court of Criminal Appeals affirmed V.S.'s conviction and sentence on direct appeal in an unpublished memorandum. V.S. v.
