¶ 1 The trial judge, the distinguished Susan Devlin Scott, determined by clear and convincing evidence that awarding primary custody to the non-biological parent of a lesbian couple, Patricia Jones ("Jones"), as against the biological mother, Ellen Boring Jones ("Boring"), was in the best interests of the twin children that had been raised by them until the couple parted.
