OPINION BY POPOVICH, J.:

¶ 1 Craig Moss appeals from the August 23, 2004 order of the Court of Common Pleas, Franklin County, which denied his petition for collateral relief as untimely filed. Upon review, we affirm.

¶ 2 A jury convicted Moss of aggravated assault of a corrections officer, 18 Pa.C.S.A. § 2702(a)(3). On April 5, 2000, the trial court sentenced him within the mitigated range to imprisonment of twelve to one hundred and twenty...
