The Defendant, Timothy Turner, appeals from his conviction of aggravated rape of a female juvenile, in violation of La.R.S. 14:42. We affirm and remand.

The Defendant was charged with the offense on January 30, 2003, pled not guilty at his arraignment, and was tried on December 2, 2003 by a twelve-person jury. He was found guilty. On December 11, 2003, the trial judge sentenced the Defendant...
