The appellant, Jonathan Peake, was indicted for first-degree robbery. On August 26, 1999, he was convicted of second-degree robbery. On November 29, 1999, the trial court sentenced him, as a habitual offender, to serve a term of twenty-one years in prison. See § 13A-5-9(a)(2), Ala. Code 1975.
