¶ 1. A Scott County grand jury indicted Mack C. Wells for the capital murder of his thirteen-year-old stepson, Gary "Man" Wells. After a change of venue to Leake County, Wells was tried and convicted of the crime of capital murder. At the conclusion of the sentencing phase, the same circuit court jury found that Wells should receive the death penalty. In due course, the presiding judge, Honorable Marcus D.
