The defendant, Shannon Byrd, was charged by bill of information with simple kidnapping, a violation of La. R.S. 14:45(A)(4). She pled not guilty and filed a motion to quash the bill of information. The motion to quash was based upon lack of jurisdiction and lack of an essential element of the offense charged. Following a hearing, the trial court granted the motion to quash.
