MATHIAS, Judge.

Devlin Taylor ("Taylor") was convicted of Class D felony operating a vehicle while intoxicated1 in Marion Superior Court. He was sentenced to serve 730 days with 120 days executed in a Community Corrections program and 610 days suspended to probation. Taylor appeals and raises two issues, which we restate as:
