¶ 1. On December 13, 2002, Curtis Glinsey sued John Newson in the Coahoma County Circuit Court. Glinsey alleged that Newson committed a breach of contract. Newson answered and finally filed a motion to dismiss on January 5, 2004. The circuit court considered matters outside the pleadings and, accordingly, treated Newson's motion to dismiss as a motion for summary judgment.
