PER CURIAM.

The trial court entered a judgment of dismissal on appellant, Salvatore Raffone's, complaint for replevin filed against appellee, Fort Lauderdale Police Department, because appellant failed to timely give appellee pre-suit notice of his claim as required under section 768.28(6)(a), Florida Statute (2001). We affirm.

Section 768.28(6)(a) provides in relevant part:

An action may not be instituted on a claim against the state or one of its...
