On October 19, 2005, the Court heard oral argument on the application for leave to appeal the June 30, 2004 order of the Court of Appeals. On order of the Court, pursuant to M.C.R. § 7.302(G)(1), the application for leave to appeal is again considered and it is DENIED, because, by accepting a valid Cobbs agreement, defendant waived his objection to the scoring of OV-13. See People v. Wiley, 472 Mich. 153,
