THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. ECHO DIXON, Appellant.

Appellate Division of the Supreme Court of the State of New York, First Department.

June 2, 2005.

The verdict was based on legally sufficient evidence and was not against the weight of the evidence. There is no basis for disturbing the jury's evaluation of expert testimony. Contrary to defendant's argument, the evidence established that defendant damaged his prison cell by setting a fire (see People v Jackson, 265 A.D.2d 343 [1999], lv denied 94 N.Y.2d 824 [1999]).
