A Mitchell County grand jury indicted Donnell Quimbley on charges of selling cocaine and possessing cocaine with intent to distribute. At trial, the jury acquitted Quimbley of selling cocaine, but found him guilty of possessing cocaine with intent to distribute. Quimbley moved for a new trial, arguing that (1) the trial court erred in failing to grant a mistrial after prejudicial testimony was given; and (2) his attorney was ineffective in failing...
