Justice SCHMIDT delivered the opinion of the court:

Following a jury trial, defendant Sandra Barrier was convicted of driving under the influence of alcohol (625 ILCS 5/11-501(a)(2) (West 2002)). She was sentenced to two years' probation and 62 days in jail. She also was ordered to pay costs and fines in the amount of $600. Defendant appeals, arguing that (1) her right to be tried by a 12-person jury was violated when one juror was excused on the first day of trial...
