This case concerns the administration of the estate of a president of a corporation who allegedly engaged in conduct that violated his fiduciary duties to the corporation. Two substantially similar claims of corporate malfeasance were filed in Probate Court, one by the corporation itself and one by a shareholder purporting to act on behalf of the corporation. The shareholder appealed to the trial court from a Probate Court order denying his claim as untimely...
