MEMORANDUM OPINION AND ORDER

DARRAH, District Judge.

Plaintiff, Steven DeGrave, filed suit against Defendants, the National Automatic Merchandising Association Pension Plan ("the Plan") and the National Automatic Merchandising Association ("NAMA"), alleging violation of Section 510 of the Employee Retirement Income Security Act of 1974 ("ERISA"), 29 U.S.C. § 1140. Presently pending before the Court is the Plan's Motion to Dismiss.
