Domingo Rodriguez was charged with one count of unlawful possession of a firearm by a convicted felon, a second degree felony. The state filed notice to seek enhanced sentencing. Over the state's objection, the court offered Rodriguez a downward departure sentence of eighteen months of probation as an habitual violent offender in exchange for a plea of no contest, conditioned on the state deciding not to appeal.
