FLYNN, J.

The acquittee, Gregory Gillespie, appeals from the trial court's judgment dismissing the state's petition to continue his commitment to the psychiatric security review board (board). He claims that the court improperly denied his motion to dismiss the petition for lack of subject matter jurisdiction due to the state's use of an incorrect docket number in referencing the matter for which he had been committed.
