This matter is before the Court for consideration of a Fed.R.Civ.P. 12(c) motion for judgment on the pleadings filed by Defendant Donald Green ("Green"). (Doc. # 118). Plaintiffs Richard and Valerie Bird ("Plaintiffs") filed a memorandum in opposition (Doc. # 132), to which Green responded (Doc. # 133).
