Desmond Earl Phillips filed a petition for post-conviction relief, attacking the validity of his prior burglary convictions which were used to enhance the sentence for a later cocaine conviction. The trial judge dismissed the petition without a hearing, and Phillips appealed raising the following issues: (1) the trial judge erred in dismissing his (Phillips's) petition as time barred, and (2) the trial judge erred in dismissing...
