No. 2004-CA-1856.

905 So.2d 335 (2005)

Calvin A. WILLIAMS, Sr. v. MIDWEST INDUSTRIAL CONTRACTORS.

Court of Appeal of Louisiana, Fourth Circuit.

May 18, 2005.

Attorney(s) appearing for the Case

Scott P. Shea, New Orleans, Counsel for Plaintiff/Appellant.

Mark E. Young, Plauche' Maselli Landry & Parkerson L.L.P., New Orleans, Counsel for Defendant/Appellee.

Court composed of Judge PATRICIA RIVET MURRAY, Judge MAX N. TOBIAS Jr., Judge EDWIN A. LOMBARD.

LOMBARD, J.

The issue before the court in this appeal is whether the Office of Workers' Compensation (OWC) judge was manifestly erroneous in his determination that plaintiff/appellant, Calvin A. Williams, Sr., was retired in accordance with La.Rev.Stat. 23:1221(3)(d) or whether he is entitled to further benefits. After review of the record in light of the applicable law and arguments of the parties, we affirm the judgment of the OWC judge.
