OPINION

MATHIAS, Judge.

Jason Davidson ("Davidson") was convicted of murder1 in Kosciusko Circuit Court. Davidson appeals, raising the following dispositive issue for review: Whether a material element was omitted from Davidson's jury instructions. Concluding a material element was omitted, we reverse and remand for a new trial.
