PER CURIAM.

This case is before this Court upon the March 4, 2005, Motion to Reinstate with Back pay of Magistrate William Tom Toler, Magistrate for Wayne County. Magistrate Toler was previously suspended without pay from his position as Magistrate by this Court, following his criminal indictment on several counts, pursuant to Rule 2.14(d)(1) of the West Virginia Rules of Judicial Disciplinary Procedure.
