Michael Kirk was indicted for armed robbery (Count 1), two counts of aggravated assault (Counts 2 and 4), theft by taking (Count 3), and escape (Count 5). The trial court dismissed the charge of theft by taking and a jury convicted Kirk of all remaining charges except aggravated assault on a police officer.
