Plaintiff-Appellant filed a petition for rehearing and rehearing en banc on October 18, 2004. In response to this petition, the panel amends its opinion as follows.

The first full sentence on page 10 of the slip opinion dated October 6, 2004 is deleted and replaced with:

"Given these circumstances — a 12-year-old's bloody appearance and injuries consistent with being hit in the mouth, his consistency in reporting...
