On November 2, 1995, the appellant, Trace Royal Duncan, was convicted of the capital offenses of kidnapping-murder, a violation of § 13A-5-40(a)(1), Ala.Code 1975, and robbery-murder, a violation of § 13A-5-40(a)(2), Ala.Code 1975.
