MAYNARD, Justice:

This case is before this Court upon appeal of a final order of the Circuit Court of Greenbrier County entered on January 20, 2004. In that order, the appellant and defendant below, Helen Regina Webster, was found guilty of the offense of domestic battery1 and was sentenced to five days in jail. The sentence was suspended, however, and the appellant was placed on unsupervised probation for one year.
