THIS MATTER comes before the Court on two separate Motions to Dismiss. Defendant Daniel Clarke moves to Dismiss Count One of Plaintiff's Complaint and requests that the Court decline to exercise jurisdiction over Count Two pursuant to Federal Rules of Civil Procedure 12(b)(1) and 12(b)(6).
