TITUS, District Judge.

On May 16, 2005, Appellant Franklin S. Carroll was found guilty after a bench trial of illegal possession of cocaine, crack cocaine, and oxycontin under 21 U.S.C. § 844 and of consuming an alcoholic beverage in the passenger compartment of a motor vehicle on a highway in violation of Md. Transp. Code § 21-903. On June 28, 2005, Appellant was sentenced to eight months of incarceration, a $9,000 fine...
