Defendant appeals his conviction for murder. ORS 163.115. On appeal, he raises numerous assignments of error, one of which was resolved in the state's favor in State v. Cunningham, 337 Or. 528, 99 P.3d 271 (2004). The Oregon Supreme Court remanded the case to this court for consideration of defendant's remaining assignments of error.
