This matter originated with the filing of a class action complaint1 in connection with the legality of late fees charged to a lessee pursuant to an automobile lease. In 1996, Wendy Simpkins leased an automobile from Primus Automotive Financial Services, Inc., a subsidiary of Ford Motor Credit Company ("FMC"). The leasing contract established a monthly payment and a late charge of 7.5% of the full amount of the scheduled payment...
