This lawsuit arises out of the alleged unlawful taking by the City of Galveston, Texas ("the City"), of property owned by Plaintiffs Wayne and Janice Mikeska ("the Mikeskas") and Mose and Carol Smith ("the Smiths") (collectively "Plaintiffs").
