Pending before the court are the parties' cross-motions for summary judgment concerning whether plaintiff Nationwide Mutual Insurance Co. ("plaintiff" or "Nationwide") is entitled to a declaratory judgment that it is not required to satisfy the claim of defendant Heidi Schmidt ("defendant") for underinsured motorist (UIM) benefits under an insurance policy issued by Nationwide to defendant and her husband.
