POLOZOLA, Chief Judge.

This matter is before the Court on the motions for summary judgment filed by defendants.1 The motions are opposed.2 The Court heard oral argument on July 28, 2004 and granted the motions for summary judgment for oral reasons assigned. The Court now supplements its oral reasons with these written reasons.
